     Everything you mentioned I wouldn't hear, I did.  I read it all over the blogosphere, what I  read in my local metro was not as comprehensive.  As an immigrant myself and a citizen for over 45 years, I understand more than most.  What I find appalling is that the bill is still not something the average American can get a complete copy of or completely understand because of its legalese.  If the "bill" was so great, why was it put together in back rooms?  Why didn't the Senator's offices I contacted personally have little knowledge of what was in the immigration bill.  Why did it come out at roughly 323 pages, get returned at 370+ and then get returned again at over 400.  Why no committee meetings?  Why not allow time for discussion and amendments?  Why censor?  Why not follow the rules?
     I'll tell you why Linda, when you see that Ted Kennedy is in league with George Bush, you had better check the contents of your wallet!!  And, how can our borders be less secure than they are now when the coyotes are shooting at our border patrol agents while another illegal is drowning in the Rio Grande?  And most important of all to me, how the hell we do know with any certainty that it is only 12 million?  There could be thirty for all we know and if they are allowed to being their entire families over it could swell to 60 million!!  Why don't you contact the Mexican government and their elites and get them to do something for the first time in nearly 500 years to better the lives of their people instead of despising us for our positions while they depend on the money the illegals send home every month.  I bet when those checks come no one in Mexico is thinking about how hard it must be to be away from home and working hard so help support their families.

Hitchens & Roberts

     It seems to me that I am very fortunate to live in this day and age with the mentality and morality of the pre-baby boomer generation.  It affords me the freedom to clearly see, hear and experience some of the insanities of this world.   But also, allows me to  see,  hear or read  debates, opinion or discussions from myriad  people  on all manner of subjects.  Like the debate with an atheist,  Christopher Hitchens and Mark Roberts, Christian evangelical.

     The "debate" if based on Hitchens book  "god is Not Great!" and I have not heard it nor read it, yet.  I have, however, read Pastor Roberts written blog posts on the book.  I have, only briefly, read some of the comments which appear to come largely from non-believers. 

     The old admonition never to discuss politics or religion seems to be gone in this day and age of the internet.  Perhaps with the "religion" of Peace acting out throughout the world with ridiculous but frightening and utterly violent responses makes this a very necessary modern thing:  to include the audience at every level from everywhere.  This, rather than a scholarly dispute or discussion away from view of the "people". 

     Anyway, I have not read Hitchens' book and may not read Roberts' either, but I don't need that, I don't think to blog about the issue of "god id Not Great" or God is dead or God is great....you get my drift.  Today, we in the Western world hear "allah" but do not hear the world "god" because one is not yet another name for the other.  Yet, we must begin to listen, pay attention, learn and make sure that the Western world and it's culture survive.  If we do not, then the globe will be plummeted into an age of darkness unlike any known before.  And an age from which we will never return. 

It occurs to me that the "debate" or "discussion" of whether a God exists is really not totally important just this minute.  The debate or discussion we should be having is "how can we control the fanatics committed to bloody world domination"?  Listening to our politicians and our religious leaders in the government, that is not a real subject.  It is a subject that is not true for a large portion of the planet.   But, it is a very hard truth we need to face.   It is never fun to look into the eyes and the soul of the devil.  But you must if you want to begin to understand just exactly what it is they are planning for you.  The hard left and the left in general are so caught up in Bush hatred, they have not the time to focus on anything else.  So, they focus on the environment, the "global warming", light bulbs, vegetarianism, furism, carism, materialism!  Why, Sheryl Crow wants us to use only  ONE  square of toilet paper!  There is people trying to live without the modern amenities that make life worth living.  Electricity, the refrigerator, the flush toilet.  People like this should move to the middle east, they'd be right at home in some of these countries.  This is what the Islamofascists wish from us. 
      So, it comes down to this:  you either have a God that is involved like Allah and demands every kind of sacrifice 24/7 or you have a God that leaves us alone because he gave us free will, or, there is no God anywhere!  Whatever the result, you and me and ours will pay the price one way or another, here, there or in the hereafter, if there is such a thing.   Maybe I wont' read Hitchens or finish with Robert's posts afterall.

Musings Only...

It is very, very tough to be born!  In particular if the labor your parent had to go through was tough or tough and long.  There is no knowing just what that kind of birth experience would leave behind in the recesses of the brain.  Nor, would it be possible to look say 20 or 50 years later and try to determine an answer to that.  All of that is tough enough, to come from a place that is warm and on which you are totally dependent for life, but to be literally pushed out into a an alien environment where there is hunger, pain, cold, noise and "aloneness".  A place where you may or may be be accepted for what you are and may not be loved well, if at all.  A world where there is no guarantee at birth that you will have all of the necessaries for a decent life.  Talk about a gamble and one not of your own choosing. 

Anyway, all of the above only to come to understand within a very short time that there are perils unknown.  Where parents, although you were lucky and were loved, nonetheless had their own problems in a variety of levels that may or may not have prevented you from feeling safe and unconditionally loved.  Add to that the fact that most of us move from place to place.  Sibling may or may not arrive over the course of time and create more problems for one not knowledgeable in the vargaries of the world they were born into.   A world where you will meet people who dislike you for a reason or no reason at all.  Peers that will make your life better or a hell you have to get through. 

Now, add to all of that mixture, a religion that  the world hates;  allows people to physically harm you or kill you in the most hideous of ways; where virtually no one will come to your assistance or defense but where you will be expected to exceed the normal behavioral modes of, not only your parents expectations, but also your  religion.  And no  one ever before  can tell  why?  Is it any wonder this world is do dysfunctional?   Is it not a miracle that you actually grow up, get old, older and finally die.   I wonder, knowing all of above, would you wish to be born?

What have we wrought???

     My oldest granddaughter a 22 year old college graduate called me a racist this evening. I called her a fish....because a fish doesn't know it's wet. She doesn't know what she thinks she knows. But she knows enough to call me a racist. Why? Because, I said that if there is only 12-14% of your kind in a place but you were responsible for 80% of the crime in your place, then your kind is represented fairly in prisons if 60-70% of your kind is locked up!
     All of this started because she took offense at the reporting about three people, one, a Mexican passenger in a car that hit a child, was yanked out by a gang of 20 African-Americans and beaten to death. In the second case a white man was just beaten badly and I really didn't know about the third. In each case there were no media reports on television, there was mention on the Internet, but only mentioned in four print papers throughout the country. I said that had the races been reversed then it would have the lead on every news show and front page of the print media.
     She, my degreed granddaughter from a "party hardy university", effectively told me that she, from her "schooling" had been privy to many studies that didn't agree with my position. My response was that if 90% of the journalists and media types, 85% of academia, 95% of celebrities and 90% of the government employees are tinfoil hatted leftist loons, then how could I know for a certainty that the studies she'd learned were valid? For this, I am a racist. After all, didn't I see the movie "A Time To Kill"?  Well, hell, knock me over please!! I explained that the movie she saw was a remake of a much older film whereupon she yells at me that the cars in the film and other things were modern and that "stuff" like the KKK still happen in the South. Goggle is the only thing I could do. Is this what tens of thousands of dollars had achieved? It so, then this country is in more than a world of really bad hurt, it is a goner

WE WON????

     The debacle called the Immigration Bill is gone, for the time being.  For the first time in my life I felt that I had actually accomplished something personally for my country.  Women didn't serve in the military when I was a
young girl, but then, girls wouldn't have wanted to be in the military in my time. 
     We won this skirmish.  So many of us actually got involved personally.  So much so that the politicians were completely caught off guard!  Then of course we had Lindsey Graham with his "tell the bigots to shut up" statement among other choice words.  Ted "the traveler" Kennedy screaming his lungs out and turning a sick shade of pinko in the process.  Voinovich on the Sean Hannity Show demonstrating for us how really well these guys know what they're voting for and, indeed, have voted for!  He thought the Fairness Doctrine was to make sure everything was "fair".... It is a sad day in the country when so many politicians behave like foolish, ignorant children whose education has been remiss.  They truly believe they hate us, the voters and except for our money and votes, they would gladly do without the bother of elections.  After all, isn't that what the tinfoil hatted leftist loons like Soros, Moore, O'Donnell want?  Brainwashing the kids for three generations and now with the newest generation being more interested in their wants and needs in such a narcissistic fashion, it will be just like having no one to tell you what to do, if, you are a politician.  So, did we win? 
      Yes, we won this small bit, but we've lost our way over so many things in the past forty years, that it may be too late to turn this massive ship called America.   But, I am willing to keep on trying and fighting every chance I can....are you?

GRAPES OF WRATH, The Wine

     Eleanor Roosevelt.....The DUSTBOWL.  The start of the entitlement mentality sweeping America.  The start of the Culture Class we're involved with today.  Because there was a time when the only classes that existed for the majority of human existence was:  rich and poor (actually, drastically poor).  That was it.  Then along came the beginning of the "middle class".  That group of people who had to be in charge of actually doing a thing in order for the rich to continue to get richer.  Soon this group began to slowly "own" their own "work" and the merchant class had begun. 
     Jump to America at the end of the 19th Century and the start of the 20th.  The Industrial Revolution was in full sway in Europe and America.  The difference was that in Europe the "old" caste system ala India was still in play and their middle class didn't develop as ours did.  Our middle class grew huge, powerful and had the financials to have what no other group of people in the history of mankind had ever had: close to true freedom!!  And, we became the most giving nation on the face of the planet.  We not only gave money, materials but our own blood, sweat and tears to help out a world that does not, even today, appreciate it.  They, having that Old World mentality, felt we owed it to them to leave our blood and bodies on their soil.  They have all, around the world, finally been able to tell us to our face exactly what they have always thought of us:  we're ignorant, lack class and are uneducated.  Of course, that doesn't prevent them from taking our money, but it helps when they spew their pap.  America did one thing no one on earth had ever been able to do before:  we got rid of hunger in our own country.  And, before you raise your eyebrows at that statement, think about what  "hungry" means in America
versus what "HUNGRY" means everywhere else.  You may wish to investigate what people in Europe (not the rich people) consider "breakfast" or "dinner" first.
     Eleanor Roosevelt, that member of the patrician class...member and wife of "old money", had to travel within the United States and "see" what the DUSTBOWL had created before she could believe what everyone knew:  the American people were starving right here on our soil, and no one was doing anything about it!!! 
      So, Eleanor came, saw and helped.  There, the concept of "entitlement" came into being as a concrete form of assistance for people who were need in this country.   Unfortunately, the rich, the "old money" types, the politicians realized what a great rallying call this was to get changes made to this great country so that more money and power could be achieved for themselves.  Her husband was a great "entitlement" provider.  He had the middle class to support it and the heart of a great people behind him.  All that has changed today.  Entitlements have destroyed the type of country and people that made America so good in the first half of the 20th Century.  They have destroyed it because, a thing received without any effort is not valued.  Only when a thing is earned can it have value, not only for the person achieving it, but for his family, friends and those around him.

Father's Day and Birthdays

06/17-18/07

     This is the very first time we will not have a Father in the house.  My husband was, to my children, father, and for his step-grandchildren father for some and grandfather for all.  He is more than missed, he left a whole we cannot fill and one we honestly didn't know was possible to have.  Today is Father's Day....tomorrow will be his birthday.  We will be together for everyone's final farewell on the 19th.  It is for my oldest granddaughter we do this because she couldn't make it before he died.  Her father is alive but her "papa" was very special and in some capacities served also as a dad, as he has done for his, mine, ours and lots of others that came in and out of our lives.
     I have found that, in many instances, I do a lot of what he used to do.  One of the most favorite things was his macaroni salad (which I actually showed him how to prepare twenty years ago) which everyone loved/loves.   So, I have taken back that task as well as the potato salad my daughter favors.  There are lots of "little" things he did for each and everyone in our family, we have been finding out what all these "Little Things" are as the months have passed without him.
     When my dad passed away unexpectedly fifteen years ago I remember it being so traumatic.  I cried my grief constantly for several months, grieved for two years.  I understand what my granddaughter is going through.  She couldn't make it down soon enough.  Her "papa" passed in less than seven days, and, I know she thought she had "time".  She didn't and now suffers for it.  Time is something we cannot never take for granted.  We simply do not have it guaranteed!!  Yes we all need to stop and smell the flowers, but is is more important that we pay attention to those small things in life that grow into huge dimensions when we've lost someone.  I am very grateful for a most important thing:  we hug and tell each other we love when we are leaving each other.  This, at least, my granddaughter has.  We will help her close her pain this Tuesday.

Blind, Deaf and Dumb....

     and now showing their "stupid" signs, too!  What hope is there in this country, in this world if you have the Islamofascists on one side of you and the blind, deaf and dumb republicans like Lindsey Graham, on the other?  We are surrounded by the terrorists in the world and the tinfoil hatted leftist loons in America.  Not that they all don't exist in every country and culture in the world today, but they have seriously begun to make their move.
     What part of "I don't want this immigration bill"? Does Lindsey not understand?  I cannot for the life of me understand why he is willing to fall on his sword for this piece of junk...what is it that Lott and/or Kennedy promised him?  He has no hope of ever becoming President so that can't be it.  He can't be the Majority Leader because he is a member of Minority.  So, what power can they dangle in front of his nose?  Maybe it's money?  Why would Senator Lindsey Graham push so hard for something that the MAJORITY of the citizens of the United States of America have consistently said "they do not want"!!
     Senator Trent Lott I understand:  he lost his power and I am sure they are offering something with lots more power than he's had in the past few years.  Lott has always seemed to me to be slimy.  I've never trusted him and he gives me the willies.  Sort of the Kennedy but only less so.
    I have called, faxed, emailed but I honestly feel that I have been abandoned by the Republican Party, the President, the Administration, even Tony Snow, for God's sake.

ENTITLED?????

    When did the American people, and the world, become indoctrinated with an ENTITLEMENT mentality?  It certainly didn't exist prior except for the rich.  The rich folk have always been sure they were more than a little entitled to everything they got, could get from everybody, everywhere.   After all, that's where this idea originated I think with the concept of leader, kings, aristocracy.  It didn't matter if you earned it, heaven forbid, but you tried, in most cases to keep what you had and get as much more as you could.
     There has never been a time in the past 100,000 years or so, when this "idea" didn't exist.  As long as there was a need for someone to "lead", those that got the "job" were bound to come to believe that their position "entitled" them to more and then better and then more still.  It is the nature of the beast:  homo sapien.  Unless there has been a huge change in evolution that I missed, homo sapiens are the only animals on the planet to want more than they need.  There is no other animal that takes to keep.  There is no other animal that kills to get.  
     The feelings and emotions that can be attributed to "entitlement" are interesting.  These feelings and emotions are anything but fair.  But no one truly speaks to this, particularly in America.  Oh, don't we all talk about the entitlement mentality of minorities or the poor?   We never include the rich, the mighty, the famous.  But, they are more entitlement challenged than almost anyone else, except for serial killers and religious terrorists, maybe.  And, that's a big maybe.  In my opinion, it is guilt that is a new emotion for these rich folk. Is it not hard to talk about poverty when you're rich and don't share all of what you have to help?  It is guilt that leads most politicians to want to take from the many (who are not rich, by the way) and give to the poor, who, maybe a larger pool of people in the world than in America.  Of course, it is not an emotional response the rich, the powerful or the famous will admit to, even if they feel it.  They probably don't know what that emotion,  guilt, is.  They have no need, they think, to feel guilt about anything.  Look at me, they say, I'm working to get some for everybody.  Maybe not enough, maybe not in a good way, but I am not sharing anything I have!!!
      Don't confuse what someone like George Soros, the tinfoil hatted leftist loons, the Deaniacs, Koskids or the Clintons are trying to do with "guilt".  What they are attempting to do is completely different.  Most of them already have more than they need, indeed Soros has enough for many millions to have enough and Hillary, who didn't have anything pre 1992, now has it all, also.  No.  They are not feeling guilty, they just want to completely turn the world upside down.  They don't want rules unless they make 'em.  They don't intend to live by those rules:  rich, mighty and famous folks don't have rules!  But, like the terrorists, they will make everybody live by rules that are barbarous!

EXODUS??? I Wish!

     I have tried not to write anything about a host of subjects because I am so
angry and frustrated but mainly because I have been emailing journalists, 
politicians, bloggers to name just a few.  There doesn't seem to be enough time in the day for me to blog just now.  My eyesight is such that from early morning until early afternoon is O.K. but later is more difficult.  I've ordered computer glasses and will advise how they are.  In the meantime, I have tried to find another word for the insanity that is the new amnesty bill.  I am bilingual so I have let my state's senators know how I feel in both languages.  A total waste of time since one is a sometime moderate liberal with a spouse that has enjoyed his government contracts quite a bit; the other is a tinfoil hatted leftist loon:  Feinstein and Boxer...see?  Total waste of time, but I called and emailed them anyway.  

There are so many disingenuous platitudes coming from every  corner of this country.  So many outright lies.  So many insincere promises.  So many grubbing politicians and supporters, all in it for the money, that it makes my stomach turn.  I especially dislike those supporters if they are ethnically hispanic...there has been an entitlement mentality for a long time, but recently, the attitude publicly displayed has been rude by everyone connected with Mexico and every illegal alien.  The reconquista supporters don't know their history or if they do, they are deliberately misleading the  15-20 million here illegally, the vast majority of them uneducated.  They are allowing these aliens to believe they have a "right" to this country whatever you and I may think!!  These reconquista supporters are racists of the lowest order, rank opportunists.  They might give them booklets on how to get across the Southwest, insist we leave water for them along their routes, but they will not help these illegals with the coyotes, the drug cartels, the Mexican police.  No, they will be robbed, raped and stolen from and often killed, but these reconquista supporters don't care.  What a horrible shame.
      And now to make matters even worse, I have Chertoff of the Homeland Security Agency, Linda Chavez a columnist here at Townhall and a Bush supporter calling me a racist and Bush alleging I am something of a Nazi!!!  No
wonder their donations as off 40%...Bush and his cohorts should be damn glad it isn't  90% as it surely will if this keeps up.  To be fair, I don't believe that Bush
wanted anything other than what is on the table.  But, to those of us who don't believe this shamamnesty is anything but a cruel joke on traditionalists and conservatives it is laughable to hear them.  They, the politicians of every stripe, don't get it:  we are not stupid.  We may not rise up often enough, but we are neither deaf nor dumb.  The tinfoil hatted leftist loons are ramping up their attack machine against any liberal who may be up for re-election soon.  We have now shown that our side is just as capable of telling them what we like or dislike.  They are surprised!  They are shocked!  They had better start running scared or their won't be a democracy in this country for too much longer.  Hillary has already said it's best for everything to be in one pot and let everyone take out just enough to get by on (unless you're rich of course, then you get to keep the pot).  Obama and Edwards go along with her.  So goodby America, so long to individual freedom...hello to european government style entitlements.  And, goodbye world.  If America isn't around to keep the engine of this planet going, then the world will grind to a halt.  We have not yet gotten to the point where the have nots will rush in and take over everything we have.  Chavez in Venezuela is right on his path.  Look, Listen and Learn!  That is where the Hillary, Obama and Edwards want us to go too!  And those 12-20 million illegals will pave the way for them!!

12 Important U.S. Laws Every Blogger Needs to Know

While the Internet still retains some of the “wild wild west” feel, increasingly Internet activity, and particular blogging, is being shaped and governed by state and federal laws. For US bloggers in particular, blogging has become a veritable land mine of potential legal issues, and the situation isn’t helped by the fact that the law in this area is constantly in flux. In this article we highlight twelve of the most important US laws when it comes to blogging and provide some simple and straightforward tips for safely navigating them.

  1. Whether to Disclose Paid Posts:

    Over the last five years bloggers have begun to displace traditional media outlets as individuals’ source for reliable information and recommendations. This development has created big opportunities for advertisers to get bloggers to endorse a product or service, primarily through posts or affiliate links. But as the practice and influence of bloggers has grown, US law has come to govern this area.

    What is the law?

    The Federal Trade Commission published a recommendation that companies who promote their product through word-of-mouth marketing must disclose these relationships. The recommendation applies explicitly to blogging, meaning that bloggers must disclose the fact that they are being paid to promote or review a product whenever that is the case.

    PayPerPost and ReviewMe are websites that link advertisers up with bloggers that want to earn money for writing about their products. In light of the FTC recommendation, PayPerPost and ReviewMe bloggers are now required to disclose the fact that they are being paid for their endorsement. But beyond these two sites, there is a much larger industry of “Buzz Advertising” which takes place through informal emails and payments between bloggers. The letter of the FTC recommendation includes these informal payments as well, meaning that even under the table reviews must be disclosed. But considering that to date no blogger has been prosecuted for violating the FTC’s recommendation, it isn’t yet clear how strict the FTC is going to be or the punishments that will be imposed.

    How to stay out of trouble:

    1. NEVER claim that you are an objective, unbiased source if you are being paid to provide information.
    2. ALWAYS make it easy for your readers to distinguish between advertising and editorial content.
    3. CONSIDER that even though the FTC’s paid review disclosure recommendation doesn’t appear to apply to links, meaning that webmasters aren’t required to “NoFollow” the paid links they give as of now, scholars at the University of Chicago Law School are currently discussing this as a future development for e-commerce law.
  2. Is Deep Linking Legal:

    One of the biggest advantages that blogging has over traditional media is the convention to include links in an article which connect the reader directly with the source. The links could direct the reader to a file, a different page on the same site or to a new site altogether. Despite the generally helpful nature of linking and the internet’s open platform, however, linking is not free from US government regulation.

    What is the law?

    The biggest issues in linking right now revolve around copyright law and deep linking. Deep linking involves a blogger who places a link on his site that leads not to the front door of a site (e.g. AvivaDirectory.com), but instead to a particular page within that site (e.g. www.AvivaDirectory.com/successful-blog-launch).

    Currently, there is no law that explicitly bans all deep linking to content you do not own. However, courts have declared that individual deep links are in violation of state law if they are not cited correctly. Thus, it is clear that passing off someone else’s work as your own by linking to a site in a manner in which it appears that the linked to content is a part of your site, is considered copyright infringement and it violates state laws that govern competitive business practices. But, it also appears that if you make it clear that the deep link you are providing isn’t to your own site then you are in the clear. The leading case in this area is Ticketmaster Corp. v. Tickets.com, Inc. where TicketMaster argued that a deep link by Tickets.com to a TicketMaster actual ticket purchase page was a copyright infringement because traffic was routed through the back door of the site. Thus far, however, no court has found that deep linking by a blogger is a copyright infringement or trespass.

    How to stay out of trouble:

    1. NEVER claim that a page or site is your work unless it actually is.
    2. ALWAYS clearly distinguish between your work and someone else’s.
    3. CONSIDER that deep linking is a pretty well-established blogging practice, so if you’re deep linking to other bloggers or newspapers, you’re probably fine. But that doesn’t mean that every other blogger knows the law, so you’re likely to get an occasional angry email. If you want to play it ultrasafe, consider emailing the webmaster for permission and including a front page link next to your deep link.
  3. The Legal Use of Images and Thumbnails:

    Images are an important way to make your posts visually more appealing and to keep the reader interested and engaged. Often, rather than creating the images they use themselves, bloggers simply use other images that they find or purchase online. Because of the obvious copyright issues with just copy and pasting someone else’s picture from their site to yours without permission (it’s a clear violation of US law), bloggers have come up with two alternative techniques for using the images of others, inline linking and thumbnails.

    Inline linking is a way of linking in which the picture appears on your blog as though it were part of the page the reader is viewing, but in fact the image is pulled from another site altogether when the page is loaded. Thumbnails, are simply smaller lower quality versions of the same image which link to the source.

    What is the law?

    Unfortunately, the law on inline linking isn’t straightforward. With image links courts are concerned both with copyright infringement and trademark infringement, which in simple terms means they want to stop bloggers from passing off someone else’s name or trademark as their own. At this point, the only way to be safe is to get permission directly from the creator of the work or to get your images through sites like Flickr which offers creative commons images or istockphoto where you can cheaply purchase royalty-free images.

    The law on thumbnails is a bit clearer. As long as you are actually creating thumbnails, which have standardized dimensions, and aren’t just reducing the size of an image slightly, a US Circuit court has held that thumbnailing is protected under the fair use exception of Copyright Law.

    How to stay out of trouble:

    1. NEVER inline link or upload images that don’t belong to you, without the owner’s permission.
    2. ALWAYS purchase or use creative license pictures if possible.
    3. CONSIDER that even though courts have stated that thumbnails CAN fall under the fair use exception, it doesn’t mean that all thumbnails are necessarily legal. There are four factors that court’s use to decide if something qualifies for fair use, and given that only a few courts have considered the issue, don’t be surprised if some thumbnails that don’t meet the four factors are deemed illegal.
  4. Laws that Protect You From Stolen Content:

    There’s nothing more infuriating than seeing the article you worked on for hours and hours appear in full on another site without any credit given. Even worse, is when their version of the article shows up higher in search engine rankings than yours. Thankfully, copyright law protects original expression, providing you with a legal recourse if your content is stolen.

    What is the law?

    Your work is protected under copyright as soon as it’s created. No record or registration with the U.S. Copyright office is required for this protection. However, you can register your work with the U.S. Copyright Office to create a public record of your claim. If you believe that your work has been stolen, you can file a copyright infringement lawsuit against the offending party. These cases are treated as strict liability tort, meaning you only need to prove that the copying occurred, the intent of the offense is irrelevant. Most successful lawsuits result in monetary awards along with injunctions against future infringing uses.

    Usually the important question isn’t whether you can win your case, its whether its worth enforcing your judgment. By and large it is impractical to enforce a judgment on someone in a third-world country simply because the cost of pursuing the claim is a lot more expensive than anything you’ll ever get out of it, that is, even if you can get jurisdiction over the person.

    How to stay out of trouble:

    1. NEVER simply blow off the fact that someone has stolen your work. You may not always be able to enforce your claim, but its always at least worth a quick cease and desist letter.
    2. ALWAYS remind would-be thieves that your work is copyrighted by making note of it on your webpage.
    3. CONSIDER the costs and potential benefits before pursuing a copyright infringement claim. If you can’t collect, it’s a good idea to get over your ego and try non-legal remedies such as letters, reporting the offender to search engines, or just asking for a link in return.
  5. Domain Name Trademark Issues:

    If you’re just starting out as a blogger, chances are you don’t have a trademark yet. However, large corporations do. If you’ve registered a domain name that a trademarked entity can lay claim to, you may have to give it up.

    What is the law?

    In November 1999, Congress passed the Anticybersquatting Consumer Protection Act, which makes it easier for individuals and companies to take over domain names that are confusingly similar to their names or trademarks. However, bringing a trademark infringement case before the court can be a long, drawn-out, expensive process. The Internet Corporation for Assigned Names and Numbers (ICANN) decided to streamline the process by creating the Uniform Domain Name Dispute Resolution Policy (UDRP). Under this policy, only three things need to be proven:

    1. The trademark owner owns the trademark,
    2. The party that registered the domain name has no legitimate right or interest in the name, and
    3. The domain name was registered and used in bad faith.

    The UDRP has made domain name disputes faster, cheaper and universal. It also tends to favor trademark holders.

    A leading case in the area of trademark disputes is Continental Airlines, Inc. v. continentalairlines.com. In that case, the dotcom was simply re-routing visitors to a travel site where they could purchase Continental Airline tickets plus pay an extra $15 fee to use the service. The court awarded the domain to the Airline on the basis of trademark infringement.

    While easy cases like Continental are relatively clear, a number of bloggers have had their domains taken from them in less clear situations. For example, the terms “no legitimate interest” or “bad faith” can be confusing and lead to honest bloggers losing domains.

    How to stay out of trouble:

    1. NEVER register a domain in the name of an existing trademark. The days of profitable cyber squatting are long gone, and attempting to do so today will only cost you time and money.
    2. ALWAYS check online to verify that there aren’t any public trademarks already registered for your domain.
    3. CONSIDER that a free search will only reveal the registered trademarks (and not even a complete listing at that). A name need not be registered in order to receive treatment as a trademark by courts. One of the best ways to do a free check for these “common law marks” is to simply do a search engine search for the name of the domain you want to use as well as some common variations.
  6. Handling Private Data About Your Readers:

    If you’re building a readership for your blog, you may want to start an email subscription list, enable comments or create a bulletin board. The use of these features may require your readers to disclose personal information to you, and depending on the nature of that information you can open yourself to legal issues.

    What is the law?

    Unfortunately there is no single law governing the privacy of information disclosed to webmasters in the US. Instead, bloggers must comply with what seems like a maze of legal jargon contained in acts such as HIPAA, P3P, the U.S. Code of Fair Information Practices, and the California Online Privacy Protection Act.

    Given the dizzying array of laws which govern private information, it might come as a surprise that following just a few guidelines can keep you legally protected. The easiest way to protect yourself from liability concerning the privacy of users is to post a privacy policy in a place that is easily visible on your site. In the policy, explain exactly how you use personal information and with whom you intend to share it. Disclose how or if you use cookies or any other kind of tracking software.

    In addition to a privacy policy, you will need to provide a clear process for opting out or modifying disclosed information. This can be as simple as providing an email address for the person to opt-out. Further, there are additional legal landmines concerning the collection of data for minors as well as medical and criminal data. Unless it is absolutely necessary (in which case you should consult a lawyer to plan your data collection strategy) just avoid this type of information altogether.

    How to stay out of trouble:

    1. NEVER share or sell sensitive information such as social security numbers, credit card numbers, bank account information, criminal background or health records.
    2. ALWAYS post a clear privacy policy stating your intentions for collecting private information along with an opt-out plan.
    3. CONSIDER that attempting to collect or sell information about your readership that you haven’t made clear in the privacy policy is not only likely to cause you legal problems, it is a sure way to lose the trust and reputation you have built up through your blogging.

  7. Who Owns User-Developed Content and Can You Delete It:

    For those of you who have opened your sites up to user-driven content, be it comments, reviews, or a bulletin board, the question of who legally owns the content is an important one for deciding what you can and cannot do with it. Thankfully, the answer is pretty straightforward, and so are the solutions for dealing with it.

    What is the law?

    It may come as a surprise to many bloggers, but you do not actually own the user-driven content on your site. Instead, it is actually the copyrighted property of the author. The analysis is pretty straightforward; copyright law only requires that an author create an original work and write it out in order to grant that person a copyright. The fact that you do not own the user-driven content on your site can create a number of headaches for bloggers, such as an obligation to remove a comment whenever the author requests.

    But by including a terms of service which spells out that you will have a license in all content posted in the site and more specifically that you will not have a duty to modify or withdraw posts but you may do so if you choose, you can ensure that you have effective control over the user-driven content on your site even if you do not have actual ownership of the content.

    How to stay out of trouble:

    1. NEVER treat comments as though you own them by manipulating them or deleting them without having included a terms of service which gives you permission to do so.
    2. ALWAYS include an extensive terms of service that explains all of your rights with respect to user-driven content.
    3. CONSIDER that if you are allowing anonymous posts you will have no way of verifying the true owner of a comment when someone emails you asking for you to take a comment down. Consequently, you should make sure to at least collect basic identifying information before allowing someone to comment or post on your site.

  8. The Duty to Monitor Your Blog Comments, and Liability:

    For those of you who have opened your sites up to user-driven content, be it comments, reviews, or a bulletin board, you may have had to deal with finding slanderous, libelous, copyright infringing, or just plain hateful speech content on your site. Even though you as the webmaster didn’t have anything to do with the content, people inevitably look to you to fix the problem or even to blame when someone gets hurt. This raises two important questions for you the webmaster; are you required (or allowed) to turn the offender’s name over to authorities, and what is your duty to monitor the user-generated content?

    What is the law?

    Section 230 of the Communications Decency Act governs a blogger’s liability for user-generated content. Thankfully, Section 230 carves out broad protection for bloggers with only two exceptions. The law was designed to encourage free speech by allowing ISP’s, bloggers, and message board webmasters to focus on building participation rather than on the potential liability of getting sued for some user’s crimes. But while it protects bloggers from things like having to monitor for defamation, slander or hurtful talk, the law does not provide protection for federal crimes or intellectual property violations, meaning that you can potentially be found contributorily liable if this type of behavior takes place on your site.

    When it comes to the question of whether you must (or can) turn over the poster’s contact information to the authorities if a suit is brought, the answer is even less clear. A leading case on the issue is Doe v. Cahill, in which the court required the service provider to identify the anonymous poster. But other courts have gone the other direction, and congress is currently revisiting the issue. At this point, the safest path is probably to explicitly state in the terms of use that you will turn over the information to any and all requesting authorities so that you will be covered if the issue ever comes up. It isn’t a perfect solution, but until the law clears up, it is a lot better than getting sued.

    How to stay out of trouble:

    1. NEVER allow criminal comments or stolen content to remain on one of your sites. Users may complain that you’re stifling their free speech, but when it all boils down you simply cannot afford to be sued.
    2. ALWAYS include in your terms of use that you will disclose all user personal information to requesting authorities.
    3. CONSIDER that moderating your message boards for federal criminal behavior and intellectual property infringements is not just an important way to keep on the right side of the law, it also sets the tone for the type of content that is permissible on your site and will help foster a friendly and collegial environment.
  9. Basic Tax Law Issues in Blogging:

    If your plan is to make money while doing what you love, you may be receiving revenue from ad sales, donations and items for sale on your site. While it is great that you’re developing revenue through your blogging, unfortunately Uncle Sam is going to want his cut. But because blogging for dollars and e-commerce are relatively new developments in the world of tax, the laws governing your e-business or blog can be rather confusing.

    What is the law?

    If a business selling goods over the Internet has a physical presence in a state or local area, then they are required to collect sales tax from customers in that area. Some businesses are finding a way around this by claiming that their e-commerce is a separate, unrelated entity from the physical store. However, states are beginning to clarify their laws to combat this practice. Thankfully, if you are just selling goods over the Internet and you do not have a physical, brick-and-mortar business, the Supreme Court has clarified in Quill v. North Dakota that you are largely exempt from collecting a sales tax.

    Even if you are exempt from state sales taxes, you will almost certainly have to pay federal income taxes on any income your sites bring in. But just because you have to pay income tax, however, doesn’t mean that you can’t be smart (and still legal) in the way you pay it. The best way to reduce your taxable income is to make sure that you are taking all of the relevant tax deductions. For example, if you do your blogging at home, you may qualify to use portions of your internet costs, utility bills, rent, mortgage interest and insurance as deductions through business use of your home exemption. Though you may want to play things even more conservatively by just taking other legitimate deductions such as the computer and research costs you undergo.

    In addition to taking all of your deductions, you should also focus on the structure and strategy of your e-business. One of the best ways to minimize your long-term taxes as a blogger is to make sure you hold a site for longer than a year before you sell it, so that it will be taxed at the lower long term capital gains rate of 15% rather than as ordinary income. Another is to make sure that you are investing up to the legal annual limit in a tax free retirement account.

    How to stay out of trouble:

    1. NEVER throw away business receipts, if you get audited they are the only defense to the IRS.
    2. ALWAYS take advantage of your available deductions and factor in tax consequences into business decisions.
    3. CONSIDER that the difference between something being taxed at the long term capital gains rate (15%) and the short term capital gains rate (35%) is so drastic that it occasionally may be worth passing up on a sale in order to make sure that you have held a domain longer that one-year so as to qualify for the lower tax rate.
  10. Limited Liability Laws and Incorporating:

    When you started blogging you probably imagined it as a pure hobby rather than a business involving serious legal issues. That’s why the vast majority of bloggers are currently operating their business as a DBA which is the default and which offers no legal protection. Bloggers are often confused as to whether they need to form a legal entity for their business, what kind they should form, and how much protection it offers. Thankfully, the answers to these questions are relatively straightforward.

    What is the law?

    Forming a legal entity, whether it be a Corporation, an LLC or an LLP, all provide limited liability. Limited liability means that when something goes wrong and someone sues the company, they can only get to the assets that are in the company and not to your personal assets such as your personal bank account. The protection offered by a limited liability entity isn’t perfect, but if you keep your personal and business finances separate, make it clear when you are acting as a representative of the company, and otherwise act like a company, the courts will generally treat you like one as well.

    Most Fortune 500 companies today are Corporations, which leads many bloggers to believe that there is something desirable about forming that model for themselves. The truth, however, is that for almost every single blogger forming an Limited Liability Company (LLC) is the way to go. An LLC carries all the same legal protections as a Corporation (in fact courts apply the exact same statutes to both), while letting you avoid all of the administrative hassles and giving you a better tax arrangement.

    Forming an LLC is a quick and relatively cheap process:

    1. Choose a name for your business that complies with your state’s LLC rules.
    2. File articles of organization with your state’s LLC filing office.
    3. Create an operating agreement to set up the rules for ownership and operation among your members.
    4. Obtain any licenses and permits that may be required for your business (not applicable for most bloggers).
    5. Additionally, some states may require that you publish a notice of your intent to form an LLC.

    How to stay out of trouble:

    1. NEVER mix your personal funds and company funds if you want to preserve your limited liability protection.
    2. ALWAYS form an LLC rather than a Corporation (Inc.) unless there are very specific reasons which apply to your unique case.
    3. CONSIDER the state you form your LLC in determines the law and to some degree the state taxes that apply to your company. The vast majority of LLC’s are formed in Delaware or Nevada because of the strong legal entity caselaw in those states which tends to favor companies over individuals in lawsuits, but at a minimum creates a set of clear laws for companies to use if something goes wrong.
  11. Spam Laws and Which Unsolicited Emails are Legal:

    We all hate the Viagra and Yahoo! Lottery emails that fill up our junk folder everyday. But what about your site’s newsletter, that couldn’t be considered spam could it? Unfortunately it might if you don’t comply with all of the requirements on mass email that US law requires.

    What is the law?

    The CAN-SPAM Act of 2003 requires the labeling of unsolicited, commercial e-mail as well as opt-out instructions for recipients, including the sender’s physical address. False or misleading header information and deceptive subject lines are also prohibited. Each violation of these provisions is subject to fines of up to $11,000.

    If you are planning to send out a mass email, you should be clear about who you are and your purpose for emailing the recipient. Make sure that all of your routing information is accurate and don’t get too creative with the subject line. Include a valid physical postal address. Finally, provide detailed instructions on how a recipient can refuse future emails from you. You can give them a menu of choices for opting out of certain types of emails, but ultimately whatever you offer must be clear and you must offer a way for the recipient to stop receiving all commercial emails from your address.

    How to stay out of trouble:

    1. NEVER use false or misleading information in the header or subject line.
    2. ALWAYS identify the email as commercial, identify yourself, state your purpose and include information on how the recipient can opt out of future unsolicited emails.
    3. CONSIDER that courts aren’t clear on what qualifies as ‘mass email.’ While almost every spamming suit brought has been against the prototypical person sending 10,000 Viagra emails a day, in theory, the person sending 150 unsolicited emails with a misleading title is also in violation.
  12. Are Bloggers Protected from Journalism Shield Laws:

    Whether the local newspaper reporter is ready to admit it or not, bloggers have begun to supplant traditional print reporters as leading journalists. Unfortunately, the laws that have protected print journalists from revealing confidential sources do not always map easily onto the role that bloggers play in media. Thus the question of whether a blogger will be legally permitted to keep his source’s information confidential if subpoenaed isn’t an easy one to answer.

    What is the law?

    Bloggers acting as reporters can be excluded from shield laws that have traditionally protected print media reporters. Currently, 31 states and the District of Columbia have recognized shield laws through state law, while judicial decisions have provided reporters protection in another 18 states. As the laws have been interpreted, however, they only apply to journalists in the traditional formal sense. That doesn’t mean that they exclude bloggers altogether, only that for a blogger to qualify for protection he must meet the standards laid out by the courts for “traditional journalism.”

    The basic question if you wish to receive shield law protection, is whether you fall within your specific state’s definition of those covered. And unfortunately every state is different. While some specifically limit the privilege to print media, those that are open to including bloggers often look for the exercise of editorial control. Editorial control includes qualification of your sources, fact checking and considerations of credibility. Basically, you need to treat your blog as though it is actually putting forth fact as opposed to your opinion, and then take regular steps to ensure that the facts you present are accurate.

    How to stay out of trouble:

    1. NEVER assume that you are protected by shield laws.
    2. ALWAYS exercise editorial control and investigate your state’s shield laws to see the specific criteria for qualifying for protection.
    3. CONSIDER that there are currently efforts underway by respected organizations who are arguing for the extension of shield laws to cover both formal and informal blogger journalists. But while bloggers in the future may be afforded this protection, today you need to do the research to know where you stand.

This should probably be taped to your bathroom mirror where one
 could read it every day. You may not realize it, but it's 100% true.

  

   1. There are at least two people in this world that you would
     die for.
     2. At least 15 people in this world love you in some way.
     3. The only reason anyone would ever hate you is because they
     want to be just like you.
     4. A smile from you can bring happiness to anyone, even if they
     don't like you.
     5. Every night, SOMEONE thinks about you before they go to
     sleep.
     6. You mean the world to someone.
     7. You are special and unique.
     8. Someone that you don't even know exists loves you.
     9. When you make the biggest mistake ever, something good comes
     from it.
     10. When you think the world has turned its back on you take
     another look.
     11. Always remember the compliments you received. Forget about
     the rude remarks.

     So...........If you are a loving friend, send this to everyone,
     including the one that sent it to you. If you get it back, then
     they really do love you.

     And always remember....when life hands you Lemons, ask for tequila
      and salt and call me over!

A Message to you

     To the "out there"....it isn't that I don't post daily, I do, in my head morning, noon and night.  Lots of time
it ends up in this blog as a draft.  Sometimes in single or multiple drafts that I then edit, delete or post.
One of the things I wish were different on Townhall is that I could date and time my own posts, but it
is a small matter.  Other times, I "post" in conversations with others so that it "feels" like I posted to
this space.
     The real reason I don't post daily is that I don't have enough time to read the 10-20 sites I go to daily,
the one newsite that has dozens of articles I have to peruse, my email where there are another dozen
or so articles to get through; pay bills, watch videos and do the normal daily domestic chores plus my
reading.  I read 2-6 books per week, mostly romance novels.  They are great to "stop" the mind and I
have learned lots of history, mores, cultures and added experiences to my bank of info.
     I cannot write as well as any of the sites I read....so many of them post several deep, intricate posts
daily...WOW I am in awe of them.  But, I don't despair, I just plug along.  I am thinking about doing my
own tiny radio show on the net through Blogradio...need to think long and hard, but it might be fun, and
who knows, others may enjoy it is they stumble into it.  I'll let you all know.

Socialism has had its day; socialism has brought moral decline, high unemployment rates, weak, unstable economies, huge governments, regulation in just about every area of one’s life; it has caused something called personal responsibility to disappear; it has brought moral relativism; it has learned us that we cannot be proud of our respective country; it has made large groups of people unnecessarily dependent on the government; it has forced us to accept the failed concept of multiculturalism; it has taught us (I mean Europeans in general with that) that whatever you do, you have to be politically correct; it has created an environment in which one is not allowed to name problems, let alone deal with them; it has taught us that criminals are not to blame for their crimes, society as a whole is and that they, therefore, should be coddled instead of punished… oef, the list goes on and on.

Socialism has weakened France, and Europe as a whole; it is time to get rid of it.
